There are two
type of visa is Issue by USA Immigration department.
(1) Non-Immigration visa :
(2) Immigrant visa :
Non-Immigration visa:
Visitor visa: Normally Visitor visa is Issue for 3-6 months.
H1b Visa: Normally H1 visa is Issue for 3 years but it can be extend for
another 3 years more.
Business Visa: Normally Business Visa is Issue for 6 months.
Immigrant visa:
Immigrant visa it means Green card.
Mainly, Green card can be possible by two ways.
Family Base Green card:
In this category, only close relative can only sponsor for
green card like...Parent, Son, Daughter, brother, sister can sponsor.
Employment Base Green card:
In this category employer can sponsor for specific job.
In this green card following step must finish to get green card.
1. Labor certificate : Labor certification is very important step for
employment base green card.
in this step, Employer has to do advertise in News paper and if they
don't get proper person
for particular job then they can sponsor any non-immigrant person for
green card.
Labor certificate timing is different in each state in USA.
There are two type of labor certification.
=> Regular Labor certification.
=> RIR (Reduction in Recruitment)
RIR is fastest way to get green card. In NY, It take around 12-18 month.
Regular Labor certification take around 2-3 years in NY.
After, Labor certification is approve then lawyer will fill for
I-140,I-485, I-765.
2. Finger print. It take 2-3 months after labor certification in NY.
3. EAD (Employment Authorization Card or Work Permit) :
For EAD lawyer fill I-765 form. It take 2-3 months
after filling I-765.
4. Advance payroll : It take 2 months. By this advance payroll candidate
can legally go outside
of USA and come back. It is valid for 1 years.
5. I-140 : It take 4-6 months. This is very important step. In this
case, Immigration department will check background information about
company.
6. I-485 : (Adjustment of Status) It take 12 to 18 months.
7. Finally Green card stamp on Passport.
After I-485 approve, candidate will get letter from BCIS for final
interview.
At the same day candidate will get green card stamp and within 1 year
candidate
will get Plastic card Green card at Home.
